By accessing or using the Chamomile content automation platform ("Service"), operated by gardenpatch ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Chamomile is a multi-tenant content automation platform that provides SEO research, content generation, publishing, indexing, and performance optimization capabilities. The Service is provided on an "as-is" and "as-available" basis.

3. Account and Access

  • You are responsible for maintaining the security of your authentication credentials and API tokens.
  • You must not share access credentials with unauthorized parties.
  • You are responsible for all activity that occurs under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, defamatory, harmful, or infringes on third-party rights.
  • Spam, deceive, or mislead readers or search engines.
  • Attempt to access other tenants' data or resources.
  • Interfere with or disrupt the Service or its infrastructure.
  • Reverse-engineer, decompile, or extract source code from the Service.
  • Exceed rate limits or usage quotas associated with your plan.

5. Content Ownership

  • Your Content: You retain ownership of all content you create using the Service, including generated articles, images, and metadata.
  • AI-Generated Content: Content generated by the Service's AI capabilities is provided for your use. You are responsible for reviewing and verifying all generated content before publishing.
  • Platform Content: The Service's interface, documentation, and underlying technology remain the property of the Company.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We maintain strict tenant data isolation — your data is never shared with or accessible to other tenants.

7. Service Level and Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service.
  • Scheduled maintenance will be communicated in advance when possible.
  • Enterprise plans include SLA guarantees as specified in your service agreement.

8. Payment and Billing

  • Paid plans are billed monthly or annually as selected.
  • Prices are subject to change with 30 days' notice.
  • Refunds are handled on a case-by-case basis.
  • Failure to pay may result in service suspension.

9. Third-Party Services

The Service integrates with third-party platforms including Notion, WordPress, Google Search Console, OpenAI, and Anthropic. Your use of these integrations is subject to their respective terms of service. We are not responsible for third-party service outages or changes.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

  • You may terminate your account at any time by contacting us.
  • We may terminate or suspend access for Terms violations.
  • Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
